Complaints procedures for Department for Transport, Local Government and the Regions

General Comment-

The Department of the Environment, Transport and the Regions has been split into the Department of Transport and the Department of Local Government and Regions and the Agencies included within these two departments are as follows:

Driver and Vehicle Licensing Agency
Driving Standards Agency
Vehicle Certification Agency
VOSAVehicle and Operator Services Agency
Highways Agency
Planning Inspectorate
Fire Service
Housing Corporation

Health and Safety Executive
Each Agency has a separate complaints procedure although the broad procedures below apply for each of them. We assume that the DTLR, as the DETR did, will have a complaints officer who you can contact if you are unhappy with the response from an agency (see step 2). If your complaint regards general policy issues you are advised to express your views to the Minister, to your MP or SMP. If you want to air your views on policy why not use our Open Forum facility to post a message or opinion for others to see and respond to.

Step 1 -

Local Resolution 1: You are advised to complain directly to the individual or department concerned.
If you are unsure who to complain to, the DTLR has a Public Enquiry Helpline which can put you on the right track (see link below).

Step 2 -

Local Resolution 2: Your next step is to contact the chief executive of the relevant department or the complaints officer and refer your complain to her/him.

Step 3 -

Authorities: If you remain unhappy with your treatment by the DTLR then you should ask your local MP to refer your complaint to the Parliamentary Ombudsman for complaints against departments and agencies involved in English matters. For complaints against certain departments and agencies in Scotland, you can ask your SMP to refer your case to the Scottish Parliamentary Commissioner for Administration. For complaints against certain departments and agencies in Wales, you can complain directly to the Welsh Administration Ombudsman. For complaints against departments and agencies in Northern Ireland, you can complain to the Northern Ireland Ombudsman via a MLA.

Step 4 -

Court: Failing all else you can still go to court to resolve your dispute. Details of small claims court and other procedures are given in the Legal Section of this site. You can also contact the Community Legal Service (justask.org.uk) that gives access to free advice. Otherwise your local Citizens' Advice Bureau will give you advice and will sometimes organise free legal representation for you.
